Proposed road closing under Section 38B Roads Act 1993

On 1 July 2018, new legislative provisions in respect of road closures by local councils came into effect under Division 3 of Part 4 of the Roads Act 1993 (the Roads Act) and the Crown Land Management Act 2016. The following proposed road closures which were previously notified by Woollahra Municipal Council prior to 1 July 2018 must now be notified under the current provisions of the Roads Act. Pursuant to Division 3 of Part 4 of the Roads Act, notice is given that Woollahra Municipal Council proposes to close the part of the road reserves of the council public roads listed in Schedules 1 – 6 below. Upon closure of the part of a road reserve described in a Schedule, Council intends to sell that part to the person described in the Schedule:

Schedule 1: Council is considering the closure and sale of a part of Wunulla Road reserve adjoining 8 Wunulla Rd, Point Piper NSW 2027. Upon closure of the part of the Wunulla Rd road reserve Council intends to sell the land to the land owner of 8 Wunulla Rd, Point Piper NSW 2027. This rectangular shaped area has an estimated average depth of 5.6 metres and length 16.2 metres. It is estimated to be some 94 square metres in size, subject to final survey.

Schedule 2: Council is considering the closure and sale of a part of Wunulla Road reserve adjoining 2 Wunulla Rd, Point Piper NSW 2027. Upon closure of the part of the Wunulla Road road reserve Council intends to sell the land to the land owner of 2 Wunulla Rd, Point Piper NSW 2027. This is rectangular in shape. This has an estimated average width of 8 metres and length 15 metres. It is estimated to be some 120 square metres in size, subject to final survey.

Schedule 3: Council is considering the closure and sale of a part of Queens Ave Road reserve adjoining 5 Queens Ave, Vaucluse NSW 2030. Upon closure of the part of the Vaucluse Rd road reserve Council intends to sell the land to the land owner of 5 Queens Rd, Vaucluse NSW 2030. This rectangular shaped area has an estimated average width of 4.7 metres and length 15.1 metres. It is estimated to be some 80 square metres in size, subject to final survey.

Schedule 4: Council is considering the closure and sale of a part of Queens Ave road reserve adjoining 7 Queens Ave, Vaucluse NSW 2030. Upon closure of the part of the Queens Ave road reserve Council intends to sell the land to the land owner of 7 Queens Ave, Vaucluse NSW 2030. This rectangular shaped area has an estimated average width of 5.2 metres and length 18.7 metres. It is estimated to be some 100 square metres in size, subject to final survey.

Schedule 5: Council is considering the closure and sale of a part of Cranbrook Road road reserve adjoining 42 Cranbrook Rd, Bellevue Hill NSW 2023. Upon closure of the part of the Cranbrook Road road reserve Council intends to sell the land to the land owner of 42 Cranbrook Rd, Bellevue Hill NSW 2023. This rectangular shaped area has width of approximately 6.5 metres and length 18.5 metres.  It is an estimated 120 square metres in size as shown in the attached plan, and is used for a private garage, access stairs, landscape vegetation subject to final survey.

Schedule 6: Council is considering the closure and sale of a part of Wunulla Rd road reserve adjoining 592 New South Head Rd, Point Piper NSW 2027. Upon closure of the part of the Cranbrook Road road reserve Council intends to sell the land to the land owner of 592 New South Head Rd, Point Piper NSW 2027. The subject road reserve area is rectangular in shape and has average width of 8 metres and length 23 metres. It is an estimated 170 sqm in size subject to final survey.

All interested persons are invited to make submissions concerning the proposals to the General Manager, Woollahra Municipal Council, PO Box 61, Double Bay NSW 1360, before 4:30pm on Wednesday 19 December 2018.

Please note, that under the provision of the Government Information (Public Access) Act 2009, such submissions may be referred to third parties for consideration.

Once the submission period is completed, Woollahra Municipal Council will consider all duly made submissions before deciding whether to continue with the road closure proposals.
