Woollahra LEP 2014 (Amendment 38) 136-148 New South Head Rd, Edgecliff

On 17 May 2024, the Woollahra LEP 2014 was amended to increase the permitted building height from 14.5m to 46m and the floor space ratio from 1.5:1 to 5:1 at 136-148 New South Head Road, Edgecliff. The site comprises the following lots:

  • Lot 1 DP 663495
  • Lot 1 DP 1092694
  • Lot 2 DP 983678
  • Lot A DP 443992
  • Lot B DP 443992

Council considered a post-exhibition report on 12 Feburary 2024 and resolved to recommended that the Department of Planning, Housing and Infrastructure (DPHI) finalise the planning proposal.

The DPHI, as the local plan-making authority, proceeded to finalise the planning proposal and the amendment came into effect on the day which it was published in the NSW Government Gazette. A copy of the amending instrument is available on the NSW Legislation website.

A draft Voluntary Planning Agreement (VPA) was considered and supported by Council on the same day in February 2024.

Subsequently, on 26 February 2024, Council entered into a VPA with the developer to ensure that a share of the land value increase facilitated by the revised controls will contribute towards public infrastructure.
