State-wide changes to the exempt and complying development

The NSW Government, as part of its ongoing reforms, recently released the first stage of the NSW Housing Code. The Housing Code takes the form of a State environmental planning policy (SEPP), being - State Environmental Planning Policy (Exempt and Complying Development Codes) 2008. The SEPP contains the 'Exempt Development Codes' and the 'General Housing Code' (for complying development).

For Woollahra Council, the Exempt Development Code in the SEPP applies. However, the General Housing Code for complying development does not apply as all land in the Woollahra local government area is 'excluded land' under clause 1.19(2) of the SEPP.

The SEPP has a State-wide application and commences on 27 February 2009.
