On 14 December 2007 Double Bay Marina Pty Ltd lodged a development application which seeks consent for the redevelopment of the Double Bay Marina.
The proposal is designated development. The Director General of the Department of Planning has advised the applicant that we are the consent authority and the Director General has provided the applicant with his requirements for the Environmental Impact Statement (EIS).
A staff report (PDF file) with annexures (PDF file) has been prepared which assesses the merits of the proposal. The report was considered by our Strategic & Corporate Committee on 2/9/08. The Committee recommended that the Council resist the applicant's appeal to the Land & Environment Court for 39 reasons. The Committee meeting was followed by an Extra Ordinary Council meeting to consider the Committee's recomendation. The Committee's recommendation was adopted at the Extra Ordinary Council meeting.

On 21/5/08 we received notice that the applicant lodged an appeal with the Land & Environment Court against the deemed refusal of the DA.
The matter has been set down for hearing on 15/12/08 to 19/12/08.

On 4 December 2007 the Maritime Authority of NSW, trading as NSW Maritime, granted land owner's consent to the applicant subject to a number of conditions. On 12 December 2007 NSW Maritime amended 2 conditions of the land owner's consent.
The Land Owner's Consent (PDF file) allows the applicant to lodge the development application with the Council. The granting of land owner's consent does not imply that NSW Maritime has conducted an environmental assessment of the proposal in accordance with the Environmental Planning and Assessment Act 1979 or that it supports the proposal. NSW Maritime advises that it reserves its right to make comment on the environmental impacts of the proposal during the assessment of the DA by the consent authority (Council).
