Exempt development under Council’s DCP

Exempt development under Council’s DCP for Exempt and Complying Development 2000

Exempt development is characterised as minor development that has minimal environmental impact on neighbourhood amenity.

Exempt development does not require Council consent provided all the development standards prescribed for the exempt development type are met.

Council's DCP for Exempt and Complying Development (PDF file, 525k) identifies 53 types of development as exempt development.

However, many of the exempt development types in Council’s DCP no longer apply as they overlap with exempt development in the State Codes SEPP. Under the State Codes SEPP this is referred to as the “same development” (clause 1.10).

What this means is that only 20 of the exempt development types in Council’s DCP continue to apply. These are listed in Table 2 below.

If you think your development is exempt development under Council’s DCP you must refer to:

  • Section 2.2 for the General development criteria for exempt development, and
  • Section 2.3 Table 1 - Exempt development which sets out the specific development standards that apply to each development type.
