Change of use of premises such as changing an existing shop to another shop or changing an existing office to create another type of office, may be carried out as exempt development without the need for development consent, subject to compliance with the specific provisions in the SEPP (Exempt and Complying Development Codes) 2008, Part 2, Subdivision 10A, Clauses 2.20A and 2.20B.
If the change of use of premises does not comply with the development standards in Subdivision 10A you may be able to undertake the proposed works as complying development subject to compliance with specific provisions in the SEPP (Exempt and Complying Development Codes) 2008, Part 5 – General Commercial and Industrial Code, Subdivision 2, Clauses 5.4, 5.5 and 5.6. Under these circumstances, the premises is not to be used until a complying development certificate has been issued by Council or an accredited certifier and all relevant conditions satisfied.
Any proposal that does not comply with the development standards detailed in the exempt or complying provisions of the SEPP will require you to submit a Development Application.
